text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">\u00c9 importante lembrar tamb\u00e9m que as estudantes ou aquelas que n\u00e3o tenham sal\u00e1rio, mas efetivam contribui\u00e7\u00f5es para o INSS por pelo menos 10 (dez) meses, t\u00eam direito ao recebimento do sal\u00e1rio-maternidade e, neste caso, o valor do benef\u00edcio corresponder\u00e1 ao sal\u00e1rio de refer\u00eancia da contribui\u00e7\u00e3o.<\/span><\/p><p dir=\"ltr\" style=\"line-height: 1.295; text-align: justify; margin-top: 0pt; margin-bottom: 8pt;\"><span style=\"font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Igualmente, fazem jus ao sal\u00e1rio-maternidade as mulheres que sofram aborto espont\u00e2neo ou que deem luz a um beb\u00ea natimorto, assim como adotantes e pessoas que possuem a guarda judicial de uma crian\u00e7a com fins de ado\u00e7\u00e3o, sendo certo que, neste \u00faltimo caso, o benef\u00edcio ser\u00e1 recebido por uma dos adotantes.\u00a0<\/span><\/p><p dir=\"ltr\" style=\"line-height: 1.295; text-align: justify; margin-top: 0pt; margin-bottom: 8pt;\"><span style=\"font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">No que tange ao tempo de afastamento, nota-se que atualmente vigora o tempo m\u00ednimo de 120 (cento e vinte) dias corridos, podendo chegar ao m\u00e1ximo de 180 (cento e oitenta) dias.\u00a0<\/span><\/p><p dir=\"ltr\" style=\"line-height: 1.295; text-align: justify; margin-top: 0pt; margin-bottom: 8pt;\"><span style=\"font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">As mulheres desempregadas tamb\u00e9m t\u00eam direito ao sal\u00e1rio-maternidade, desde que a \u00faltima contribui\u00e7\u00e3o ao INSS tenha ocorrido at\u00e9 12 meses antes do parto, ou 24 meses para quem contribuiu por pelo menos dez anos.<\/span><\/p><p dir=\"ltr\" style=\"line-height: 1.295; text-align: justify; margin-top: 0pt; margin-bottom: 8pt;\"><span style=\"font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">O afastamento da mulher, poder\u00e1 ocorrer at\u00e9 28 dias antes do parto, ou ent\u00e3o a partir da data de nascimento do beb\u00ea, ficando a crit\u00e9rio da gestante.<\/span><\/p><p dir=\"ltr\" style=\"line-height: 1.295; text-align: justify; margin-top: 0pt; margin-bottom: 8pt;\"><span style=\"font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal;
