Acaso seja constatada a incapacidade permanente para o trabalho, sem possibilidade de reabilita\u00e7\u00e3o para outra fun\u00e7\u00e3o, a aposentaria por invalidez ser\u00e1 indicada.\u00a0<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.295;  text-align: justify; margin-top: 0pt; margin-bottom: 8pt;\"><span style=\"font-family: Arial; color: #000000; background-color: transparent; font-weight: bold; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Contudo, na hip\u00f3tese de o INSS n\u00e3o conceder o benef\u00edcio, o segurado dever\u00e1 procurar um advogado para avaliar a possibilidade de ingressar junto ao Poder Judici\u00e1rio (Justi\u00e7a) para obten\u00e7\u00e3o do benef\u00edcio, caso em que ser\u00e1 submetido a uma nova per\u00edcia.\u00a0<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.295;  text-align: justify; margin-top: 0pt; margin-bottom: 8pt;\"><span style=\" font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">A doen\u00e7a que tornou o trabalhador incapacitado para o trabalho dever\u00e1 ser anterior \u00e0 sua filia\u00e7\u00e3o Previdenci\u00e1ria, sendo que a car\u00eancia (tempo m\u00ednimo de contribui\u00e7\u00e3o) \u00e9 de 12 (doze) meses.<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.295;  text-align: justify; margin-top: 0pt; margin-bottom: 8pt;\"><span style=\" font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">Eventualmente pode haver um adicional de 25% (vinte e cinco por cento) sobre o valor do benef\u00edcio na hip\u00f3tese de o aposentado necessitar de assist\u00eancia permanente de outra pessoa.\u00a0<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.295;  text-align: justify; margin-top: 0pt; margin-bottom: 8pt;\"><span style=\" font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal; text-decoration: none; vertical-align: baseline; white-space: pre-wrap;\">O fim do benef\u00edcio ocorre quando o segurado recupera a capacidade de trabalho ou por ocasi\u00e3o do \u00f3bito, caso em que poder\u00e1 ser transferido para a esposa ou algum dependente, conforme o caso.\u00a0\u00a0\u00a0<\/span><\/p>\n<p dir=\"ltr\" style=\"line-height: 1.295;  text-align: justify; margin-top: 0pt; margin-bottom: 8pt;\"><span style=\" font-family: Arial; color: #000000; background-color: transparent; font-weight: 400; font-style: normal; font-variant: normal;
